1. Acceptance of terms

By downloading or using the Pikel apps, or by using pikel.app, you agree to these Terms of Service. If you do not agree, do not use them.

2. Description of service

Pikel is the Pikel mobile apps for iPhone and Android together with the website at pikel.app. It is used for organizing games, managing clubs, running round robin formats, taking tournament registrations, and coordinating with other players. The service is provided by Plyvo Apps LLC.

3. Eligibility and Age Requirement

Pikel is intended for users aged 13 and older. By creating an account, signing in, or using Pikel in any way, you represent and warrant that you are at least 13 years old. This representation is a material term of these Terms of Service.

If you are between 13 and the age of majority in your jurisdiction (typically 18), you represent that your parent or legal guardian has reviewed and accepted these Terms on your behalf.

We do not knowingly collect personal information from anyone under 13. If we become aware that a user is under 13, we will disable the account and delete the associated personal data in accordance with the U.S. Children's Online Privacy Protection Act (COPPA) and any other applicable laws. If you believe a user is under 13, please contact us at support@pikel.app and we will investigate promptly.

By continuing to use Pikel, you reaffirm that you meet this age requirement.

4. User accounts

You need an account to RSVP to a game, register for a tournament, host, or message another player. Public event pages on pikel.app can be read without one. You are responsible for maintaining the security of your account credentials.

5. User conduct

You agree not to use Pikel to harass, abuse, or harm other users; post inappropriate, offensive, or illegal content; attempt to gain unauthorized access to other accounts; or interfere with the operation of the service.

Our Code of Conduct sets out how we expect players, organizers and clubs to behave on Pikel.

6. Content

You retain ownership of content you create (messages, game results, profile information). By posting content, you grant us a non-exclusive license to display it within Pikel to other users as intended by the features you use.

7. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time from your profile in the app. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

8. Disclaimer

Pikel is provided "as is" without warranties of any kind. We are not responsible for injuries sustained during games organized through the app.

9. Changes to terms

We may update these terms from time to time. Continued use of Pikel after changes constitutes acceptance of the new terms.

10. Governing law and disputes

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Any dispute arising from these terms or your use of Pikel shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration will be conducted on an individual basis — class actions and class arbitrations are not permitted.

Exceptions: Either party may (a) bring claims in small claims court if eligible, or (b) seek injunctive or equitable relief in any court of competent jurisdiction to protect intellectual property rights.
